TERMS & CONDITIONS
Bookings and cancellation policy
All booking requests (either online or in-person bookings) are confirmed upon receipt of payment. When Vine Root Tours Pty (Ltd) receives your payment, an automated email will be generated confirming your booking. Please contact us immediately should you not receive the confirmation email.
Once your booking request is received, invoiced, and full payment made, it is refundable as per the conditions below:
(a) Less than 48hrs before scheduled tour = No refund
(b) Less than 72hrs before scheduled tour = 50% refund
(c) More than 72hrs before scheduled tour = 90% refund (a fee will be deducted for bank fees)
(d) All scheduled tours = the amount for any pre-booked non-refundable activities, reservations, etc. will be deducted from the total amount refundable.
(d) This tour is not weather-dependent; therefore, no refund for tours cancelled by the client due to inclement weather
Personal Information
Vine Root Tours Pty (Ltd) collects certain personal information from you either while you browse our website or gather information required for bookings (your contact details, the form of identification, and other information we need to confirm your booking). We keep and treat all personal information according to the relevant provisions of the Protection of Personal Information Act 4 of 2013.
All personal information collected by us is kept in a safe place and not used for any other purpose than that for which it was originally collected. If you have any questions about any personal information collected or in our possession, you can contact us at any time.
Indemnity and Liability
All tours booked are at your own risk. Vine Root Tours Pty (Ltd) shall not be liable for any loss, damage, injury, death, additional cost, accident, delay, or irregularity experienced by you regardless of how it arose, even in such instance of an error, negligence, act or omission by Vine Root Tours Pty (Ltd), its employees or agents in carrying out the arrangements of the tour, or otherwise in connection with the tour. You shall have no claim of any nature or kind against Vine Root Tours Pty (Ltd).
You hereby indemnify and hold harmless Vine Root Tours Pty (Ltd), its employees, and agents from and against any costs, liability, loss, injury, damage, penalty, fine, settle mentor expense (including but not limited to fines, damages awarded, costs of mitigating damages) or any other claims of whatsoever nature or kind made by any third parties whatsoever arising out of this agreement. Under no circumstances shall Vine Root Tours Pty (Ltd) be liable for any indirect or consequential damages, or special damages arising out of or relating to its rendering of services or failure to render those services.
You consent to Vine Root Tours Pty (Ltd) using photographs and video footage from the tours for marketing-related purposes.
Vehicle Safety
You are responsible for wearing your seatbelt when travelling in any vehicle. Vine Root Tours Pty (Ltd), and/or the tour operator and Service Providers are not liable for any injury, loss, damages, fines, claims, or death resulting from any accident or incident if you were not wearing your seatbelt at the time of the accident or incident when the vehicle was equipped with them. You are responsible for following the safety instructions provided to you. You are responsible for the regulations for safety when accompanying minors. Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) does not provide child safety devices.
Punctuality on the Tour
Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) is not responsible for any losses, including missed sightseeing, meals, inclusions, optional excursions, or having to make alternate transportation or lodging arrangements, if you fail to meet the representatives at assigned timings and places/pick-up points while on tour. Vine Root Tours Pty (Ltd) (and/on behalf of the tour operator if applicable) will not refund or cover any cost or expenses incurred, or compensate for any missed inclusions or optional excursions claimed, due to your inability to maintain punctuality.
Smoking
Smoking is not allowed on transportation that is exclusively provided by Vine Root Tours Pty (Ltd). Smoking includes cigarettes, e-cigarettes, cigars, e-cigars, or any other smoking or vaping device. You are responsible for abiding by and adhering to the Service Provider's terms & conditions, including those that relate to smoking. Smoking is only permitted in designated areas at restaurants, hotels, public spaces, etc.
Safety & Medical Care
Certain risks and dangers may arise beyond our control, including but not limited to:
• the hazards of travelling in undeveloped areas;
• travel by boat, train, automobile, aircraft, or other means of transportation;
• forces of nature;
• political unrest;
• acts of lawlessness or terrorism;
• accident or illness in remote regions without means of rapid evacuation or availability of medical facilities.
Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) will have no liability to you regarding the provision of medical care or the adequacy of any care that may be rendered. While Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in a tour and/or optional excursions, you agree that you will indemnify and hold harmless Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) regarding the provision of medical care or the adequacy of any care rendered.
Vine Root Tours Pty (Ltd) is not responsible for such risks and dangers that may arise beyond its control. Payment of your trip indicates you accept these risks and dangers and agree to hold Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) harmless for them.
Accommodation Compliance & Responsibilities
When staying in accommodations provided by Vine Root Tours Pty (Ltd), you have specific obligations and responsibilities to uphold. By agreeing to these Terms, you agree to the following:
• You agree not to invite any individuals into the hotel, whether in common areas or your room, whose behavior might disrupt the property or disturb other guests.
• You agree not to bring any outside food or beverages into the hotel, including common areas and your room, unless explicitly permitted in advance.
• You agree not to interfere with the operations of the hotel, including its staff.
• You agree to comply with all safety regulations within the hotel, including those set by staff and emergency personnel.
• Upon check-in, you agree to provide a valid credit card, which will be authorized for payment of any incidentals you utilize during your stay. This includes, but is not limited to, room service, bar or restaurant services (outside those provided within the itinerary), movies, mini-bar, or porterage services.
Trip Documents
It is your responsibility to obtain and have in your possession proper and valid documentation required for entry and departure for each country you travel. You are solely responsible for the cost incurred during travel for missing, incomplete, or defective documentation. Vine Root Tours Pty (Ltd) (and/or the tour operator if applicable) is not liable for any loss or expense incurred due to loss, damage, or errant entry, exit, or travel documentation.\
Waivers General
During the course of your tour or excursion, you may encounter the opportunity to participate in additional, optional activities that are provided by independent third-party suppliers. The suppliers of those optional services may render those services subject to separate and additional terms and conditions, or may require you to execute additional documents, waivers, or releases. It is understood that any assumptions of liability, waivers, or releases that are part of the suppliers’ terms and conditions or that are required by those independent suppliers will also inure to the benefit of Vine Root Tours Pty (Ltd).

Using our website or making payment of the booking fee constitutes an acceptance by you of these terms and conditions.
